- Article 3: Information on the auction and the auction lots
(1) All items submitted for auction may be inspected during the exhibition at the Company's office at 26 Eötvös u. 26, Budapest VI (C). The description of each lot and the determination of its condition will be made to the best of the knowledge and belief of the Company's expert. The items will be sold with all faults and imperfections in the condition in which they are found at the time of the auction. A claim after knockdown, within 30 days of the auction date, will only be considered if the buyer discovers a gross defect (ear mark, repaired hole, soldering) on the purchased piece which is not indicated in the catalogue.
(2) The auctioneer may withdraw individual lots until the auction begins. Coins minted by a grading company (e.g. NCG, PCMG, etc.) may not be returned for any reason, even if they are claimed to be genuine. Should the Auction Buyer open the lot from the case, the guarantee will be immediately voided.
(3) The Auctioneer GUARANTEES THE REALITY OF ALL DATA. The illustrations are part of the description. In case of discrepancy between the picture (illustration) and the text description, the text description shall prevail.
The Company reserves the right to amend or correct the catalogue, the lot description or the pictures, and to withdraw any Auction Lot without giving any reason until the auction has started. The Company accepts no liability for any errors in the catalogue.
(4) The Company shall publish an auction notice on its website at least 14 working days before the auction date, stating the date and time of the auction, the method and conditions of registration, and the place and time for viewing the auction lots.
- Article 3: Commissioning
(1) A legal person may be represented by a proxy, other than a statutory body, provided that the proxy is sufficient in relation to the auction lot.
(2) The auction participant is entitled to authorise the Company to represent him/her at the auction, on the basis of a binding power of attorney, a specimen of which is also available on the Company's website (www.procopius.hu) and which must be delivered to the Company at least 48 hours before the auction. The Company is under no obligation to accept the Power of Attorney and will decide on an individual basis.
(3) In the event of a power of attorney of the Company pursuant to paragraph 2 of this Article, the Auction Participant shall give instructions to the Company as its attorney in the form of a so-called written limit set out in the written mandate, which shall specify the highest possible bid for the purchase of the Auction Lot that the Company may submit as the Auction Participant's attorney.
(4) The Company shall execute the written offer in accordance with the purchase order. If the identity or the solvency of the offeror cannot be clearly established, the Company shall be entitled to request an advance payment as security for payment. The rules for the advance payment are as follows:
- advance payment: 20% of the recommended price,
- method of payment: transfer to the Company's bank account,
- deadline for performance: no later than 08:00 on the day of the auction, but if the auction falls on a public holiday, then by 08:00 on the last working day preceding the public holiday.
If the advance payment is not received by the deadline, the Company is entitled to disregard the written bid and disregard it in the auction.
- In the event of an unsuccessful bid, the Auctioneer shall return the deposit immediately after the auction, but within 3 working days at the latest.
- In the event of a successful bid, the deposit will be deducted from the final purchase price.
- Article 3: The auction process
(1) Auction participants must follow the instructions of the Company and must not interfere in any way with the auction. In particular, it is prohibited to obstruct, slow down or paralyse the auction system (e.g. load attack, use of robots, input of false or manipulated data). The Company shall be entitled to exclude such participant with immediate effect.
(2) Participants in the online auction must be logged in via the online auction system auex.de before the auction starts.
(3) The auctioneer shall conduct the auction on behalf of the Company. For each Auction Lot, the system shall invite participants to submit a binding bid.
(4) Bids shall be submitted in the form of bids made through the online system. A bid is a binding legal declaration that binds the Auction Participant to purchase the given Auction Lot.
By bidding, the participant declares that:
- examined or had examined the Object,
- you have read all the information and descriptions published on auex.de,
- accepts the Auction Conditions.
(5) The prices in EUR indicated in the catalogue are also the starting prices, below which the Company will not sell the item.
(6) The amounts of the bids are set out in the following table:
- Up to 10 EUR - 1 EUR per step
- Up to EUR 50 - EUR 5 per step
- Up to 100 EUR - 10 EUR increments
- Up to EUR 300 - EUR 20 per step
- Up to EUR 600 - 50 EUR increments
- Up to EUR 1 000 - EUR 100 increments
- Up to EUR 3 000 - EUR 200 increments
- Up to EUR 6 000 - EUR 500 per step
- Up to EUR 10 000 - EUR 1 000 increments
- Over EUR 30 000 - EUR 2 000 increments
(7) A knockdown occurs when no further bids are received after the third call of the virtual hammer on the online auction system for the highest valid bid at the end of the bidding period. The Company will sell the Auction Lot to the Auction Participant with the highest bid. This shall be the purchase price of the Auction Lot between the Company and the highest bidder (hereinafter referred to as the "Buyer"), where the highest bid shall be the purchase price of the Auction Lot (hereinafter referred to as the "Purchase Price"). The amount of the successful bid shall be the Purchase Price, including the statutory VAT 27% VAT.
(8) Since the Auctioneer currently organises only online auctions, the sale and purchase contract of the Auction Lot shall be concluded at the time of the completion of the auction, provided that:
- the minimum bid amount has been reached, and
- have made a valid bid for the Lot in question.
The Company will always sell the Auction Lot to the highest bidder.
(9) In the case of valid written limit bids of the same amount, the bid received first shall have priority.
(10) The Auction Lots will be sold in the order of the consecutive identification numbers (#001, #002, etc.) indicated on the auex.de online platform. The numerical value given in the catalogue is the minimum bid (starting price) for the Lot in EUR and its HUF equivalent. This amount may not be reduced under any circumstances.
(11) If the minimum bid amount of the Auction Lot is not met after the second and third call, the Lot shall be deemed unsold. After the closing of the entire auction, the Company shall be entitled to re-auction the unsold Auction Lots in accordance with the provisions of these Rules.
(12) Exclusion of the right of withdrawal
The Buyer shall not be entitled to the 14-day right of withdrawal pursuant to Government Decree 45/2014 (26.II.) on contracts between consumers and businesses.
The reason for this is that the Auction Lot will be purchased at a public auction, where all interested parties are entitled to participate and have a prior viewing of the Lot.
The Buyer, by starting the bidding, expressly acknowledges and accepts that the contract of sale of the Auction Lot is irrevocable and binding and that the consumer's right of withdrawal does not apply.
(13) The Company is entitled to declare any bid invalid if it is recorded as a result of an obvious system failure, technical error, automated program (bot), load attack or other anomaly. The Company shall not be liable for any technical errors or disconnection on the part of the Buyer.
- Article 3: Payment of the Purchase Price of the Auction Lot
(1) The Buyer shall pay the purchase price of the Auction Lot(s) purchased by him at the Auction in the manner and within the time specified in these Auction Terms and Conditions. The purchase price shall include the statutory value added tax 27%, which is non-refundable by law.
(2) On the day of the conclusion of the contract of sale of the Auction Lot, the Company shall issue an invoice to the Buyer.
The invoice is delivered to the Buyer electronically or on paper.
The Buyer is obliged to pay the purchase price within 5 working days of the date of the knock down. In the case of a written order, the payment deadline is 5 days after receipt of the invoice.
(3) Payment of the purchase price of the Auction Lot may be made in the following ways:
- by transfer to the Company's bank account:
o HUF: 12012156-01569131-00100001
o IBAN: HU43 1201 2156 9131 0020 0008
- in cash, in EUR or HUF, at the Company's shop, converted at the exchange rate prevailing on the Auction date,
- a different method of payment is only possible with the express prior agreement of the Parties.
In all cases, the costs of bank transfers, including intermediate bank charges and costs resulting from currency conversion, are borne by the Buyer. The Company will only consider the receipt of the full amount credited to its bank account as payment of the purchase price. In case of exchange rate differences, the difference shall be settled by the Buyer.
If the Purchase Price of the Auction Lot is paid by a natural person, there is no restriction as to whether the Purchase Price is paid in cash or by bank transfer, irrespective of the amount.
If the Purchase Price of the Auction Lot is paid by a legal person, the amount exceeding HUF 1 500 000 (cc. EUR 3900) may be paid only by transfer to one of the Company's bank accounts. The Company, as the payee of the payment, will not accept any other method of payment.
(4) If the Buyer purchases more than one Auction Item and does not clearly indicate at the time of payment which item he wishes to apply the payment to, the Company shall be entitled to apply the amount received at its sole discretion:
- the purchase price of any Auction Lot purchased, or
- any claim you may have against the Buyer
account
(5) If the Buyer fails to pay the Purchase Price obtained at the auction within the payment deadline, the Company shall be entitled to charge interest on arrears of 0.05% for each day of delay. In the event of recovery of the Purchase Price, the Buyer shall bear all costs (e.g. collection costs surcharge), including litigation costs, related to the recovery of the amount owed. The Company shall be entitled to assign these rights to the Seller by way of assignment for payment of the Purchase Price.
The Company may waive the purchase price instead of collecting the debt, in which case the Buyer shall pay the Company and the Seller for any losses incurred, including loss of profit.
This provision also applies in the event that a bidder or subsequent Buyer makes a valid bid (bid) and subsequently cancels its registration, but the bid of the cancelling bidder has become the highest valid bid.
(6) The Buyer shall pay to the Company a commission equal to 20% of the purchase price of each Auction Lot purchased by him at the Auction.
(7) The Buyer may only set off against the Company's claims for payment of the purchase price those claims which have been finally adjudicated by a court and/or expressly recognised by the Company. In other cases, set-off is excluded.
(8) The Company may, subject to prior agreement, provide the Buyer with the option to pay the purchase price no later than 15 days after the auction, provided that the Buyer pays an advance payment equal to 20% of the purchase price.
In the case of a written order, payment must be made within 5 days of receipt of the strike price by bank transfer or in cash at the Company's office.
- Article 11: Acquisition of ownership and transfer of the Auction Lot
(1) The title to the Auction Lot shall pass to the Buyer upon full payment of the full purchase price, the auction fee and all other payments due. From that date, the risk of damage, destruction or loss of the Auction Lot shall be borne by the Buyer.
(2) The Auctioneer shall deliver the Auction Lot only upon payment of the full purchase price, the auction fee and all debts owed by the Buyer to the Company. The Buyer shall take possession of the Auction Lot immediately upon becoming the owner thereof and shall comply with all other conditions for taking possession of the Auction Lot within such period.
The Company shall be entitled to exercise its right of retention and withhold the Auction Lot until all debts of the Buyer have been settled,
If the Buyer does not take possession of the Auction Lot within 30 days of the date of acquisition of ownership, the Company shall be entitled to charge a storage fee of HUF 5 000 (or the equivalent in EUR) per day for the physical storage and securing of the Lot. In the event of a delay of more than 45 days, the Company shall be entitled to sell the Lot and to deduct its storage and administrative costs from the proceeds.
(3) The Company shall arrange for the delivery of the Auction Item to the address provided by the Buyer at the Buyer's request, upon separate agreement. The Buyer shall bear all costs (postage, insurance, etc.) and delivery risk associated with the delivery of the Auction Item. The price for the delivery of the Auction Item shall be determined by the Company at its sole discretion, taking into account the value of the consignment and the country of destination.
(4) The cost of postage varies depending on the type and value of the dispatch, so the exact cost should be requested by the Customer in advance. The Company delivers domestically by MPL courier or MPL parcel delivery at the prevailing rates, no other delivery method is available. Delivery abroad is subject to individual pricing, which is agreed between the Parties prior to dispatch.
(5) If the Buyer intends to export the Auction Item abroad, the Buyer shall comply in advance with the requirements of applicable laws and regulations and obtain the necessary permits/consents and shall be responsible for the payment of applicable fees, taxes and duties. According to the legislation of Hungary, in the case of an object older than 50 years, if the knock-down price exceeds HUF 300,000 (cc. EUR 750), the Auction Lot is subject to an export licence. The Company shall arrange for the obtaining of the licence. In this case, the posting time will be extended by an additional 2 weeks.
(6) The place of performance of obligations in relation to the auction shall be the registered office of the Company, taking into account the fact that auctions are not typically held at the registered office of the Company.
(7) In order to ensure anonymity and data protection, the Company shall not disclose any information about the Seller to the Buyer, nor shall it disclose the Buyer's personal data to the Seller, unless required to do so by law or necessary for the performance of the contract.
- Article 3: Responsibility
(1) The Company shall not be liable to compensate for loss of profit or loss which would otherwise have occurred on the Buyer's side, nor for any damage to the Auction Lot caused by the Buyer's delay in taking delivery. The Company's obligation to indemnify shall be limited to proven actual pecuniary loss and shall be limited to the amount of the purchase price paid by the Buyer for the relevant Auction Lot.
(2) The Buyer shall notify the Company of any (hidden) defects in the Auction Lot not detectable at the time of acceptance within 30 days of the date of the auction. The Company shall not be liable for any defects reported after the expiry of this period.
(3) The valuation, expert determination and description of the Auction Lot in the Auction Catalogue are the result of professional investigations, the best knowledge and belief of the Company and due diligence. The description is intended to identify the Auction Item; it is not a guarantee of the condition, value or future market perception of the Item. The Bidder may, at his discretion, inspect the Item in person or arrange to inspect it.
The statistical data in the auction catalogue (e.g. data from rating companies) reflect only the situation at the time of publication of the catalogue.
For items sold at auctions organised by the Company, only defects and damages that may affect their price are mentioned. Possible damages are already taken into account in the estimation of the value of the Auction Lot in the Auction catalogue. The Company's liability only covers defects:
- were not recognisable from the catalogue description or image of the Auction Item, and
- which significantly affect the collector value of the Item.
(4) The Company warrants the authenticity of all Auction Lots listed in the Auction Catalogue, unless otherwise stated in the Auction Catalogue or during the Auction. The guarantee of authenticity shall be the exclusive property of the Buyer, shall not be transferable to any third party and shall be enforceable only by the Buyer.
(5) The guarantee of authenticity does not apply to items in so-called slab (NGC, PCGS, PMG, etc.) cases, as these cannot be examined without dismantling and the grading, valuation and authenticity of the items contained therein are carried out exclusively by the grading company. The Company accepts no responsibility for any grading, expert valuation, discrepancies between the grading and the auction catalogue descriptions, or for the authenticity and condition of the lots in the slab. If the Buyer removes the winning Auction Lot from the case, the warranty will be immediately voided.
(6) All potential bidders are entitled to view the Auction Lots at the times specified in the Auction Catalogue and the Auction Notice. By bidding, the Bidder acknowledges that he has duly examined the Object.
(7) Complaints concerning the quality, condition and any other visible defects of the Auction Lots may be lodged only upon personal acceptance of the Auction Lot or, in the case of delivery of the Auction Lot, within seven calendar days of the date of acceptance. No later complaints will be accepted. Claimed Auction Items must be returned in the same condition as they were delivered to the Buyer.
(8) In the case of sets, collections and lots, the Company shall sell them at auction in their entirety, „as is”. For such lots, the Company will not accept any complaints and no complaints may be lodged after acceptance.
(9)The Customer shall send complaints to the Company:
- by e-mail: info@procopius.hu
- or by post to Procopius Numizmatika Kft., 2040 Budaörs, Gyár utca 2.
